1. Data Protection. General Terms
The CLIENT authorizes Venezia Experiences LLC (hereinafter, “THE COMPANY”) to access information containing personal data for which the CLIENT is responsible, for the purpose of providing the services specified in the corresponding agreement.
Specifically, for the execution of the services derived from the engagement, the CLIENT makes personal data available to THE COMPANY for processing exclusively for the purpose of carrying out the contracted services.
THE COMPANY agrees to comply with all obligations applicable to it as a “data processor” under applicable U.S. laws, including:
The California Consumer Privacy Act (CCPA) and amendments introduced by the California Privacy Rights Act (CPRA).
Applicable Florida state regulations and any other relevant federal privacy and data protection laws.
THE COMPANY shall process personal data strictly in accordance with the CLIENT’s express instructions and shall not use the data for purposes other than those established in the service agreement.
THE COMPANY guarantees the confidentiality of all information related to the CLIENT’s activities, organization, systems, internal operations, services, and any other data to which it has access, and shall be bound by professional confidentiality obligations.
THE COMPANY agrees not to disclose, transfer, assign, or otherwise communicate personal data to third parties, except:
When there is the CLIENT’s express consent.
When legally required by competent authorities.
When necessary for the proper provision of services, under contracts ensuring equivalent data protection safeguards.
If data subjects (users or end clients) exercise their rights of access, rectification, deletion, objection, restriction of processing, or data portability and direct such requests to THE COMPANY, THE COMPANY shall promptly notify the CLIENT via email to the address provided.
THE COMPANY declares that it has adopted reasonable technical and organizational measures to ensure information security, in accordance with applicable U.S. privacy and data protection laws.
THE COMPANY shall notify the CLIENT without undue delay of any personal data breach detected, including sufficient details to enable the CLIENT to comply with their legal notification obligations.
Upon termination of the contractual relationship, THE COMPANY shall return to the CLIENT, within a maximum of 30 days, all documentation and materials containing personal data. If return is not possible, THE COMPANY shall proceed with immediate destruction and certify such return or destruction in writing, unless retention is required by law.
As a general rule, subcontracting services involving the processing of personal data is not authorized. If necessary, THE COMPANY must notify the CLIENT in advance, including the identity of the subcontractor and guarantees of legal compliance.
Both parties agree that their respective contact information and data necessary to maintain the contractual relationship shall be treated as “business contact information” in accordance with applicable U.S. regulations.
Failure by THE COMPANY to comply with these obligations may result in civil and contractual liability under Florida law and applicable federal regulations.
This privacy agreement shall remain in effect for the same duration as the service agreement between THE COMPANY and THE CLIENT.
Mobile & SMS Data Policy
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
Information sharing with subcontractors that provide support services (such as customer service providers or SMS delivery platforms) is permitted solely for operational purposes.
All other use case categories exclude text messaging originator opt-in data and consent. This information will not be shared with any third parties, except aggregators and providers necessary to deliver text message services.
